Competition rules

1. Scope/Exemption from Instagram

These terms and conditions apply to all competitions we conduct via the Instagram profile "@wayofwater.de." This promotion has no connection with Instagram and is not sponsored, supported, or organized by Instagram in any way. All information related to the competitions is provided exclusively by WAY OF WATER as the organizer of the competition and is responsible for data processing within the meaning of the General Data Protection Regulation (GDPR).

2. Eligibility/Participation

2.1 Any natural person, acting in their own name, who is at least 18 years old and residing in Germany, Austria, or Switzerland is eligible to participate. Participants who have already reached the age of sixteen but are not yet of legal age may only participate in the competition with the consent of their legal guardian.

2.2 Minors under 16 years of age and those who are legally incompetent are excluded from participation.

2.3 The organizer reserves the right to exclude participants from participation who violate these terms and conditions or who attempt to gain an advantage over other participants through undue influence or manipulation of the competition. In these cases, the organizer may also subsequently exclude participants from the competition, revoke prizes, and demand their return.

2.4 Participation is only possible within the deadline specified in the competition description. Each participant may only participate in an identical competition once.

2.5 Employees of the competition organizer, as well as employees of the companies participating in this competition and their immediate family members are excluded from participation in the competition.

3. Conduct of the competition

3.1 Participation in the competition requires following the organizer's Instagram channel. If any additional requirements are necessary for participation in the competition, this will be communicated directly when the competition entry form is offered. The competition will be held during the specified period. All participants who meet the specified requirements by the respective time of the draw will be considered for the competition. Immediately after the end of the participation period, the winner will be randomly drawn from among the participants.

3.2 Any change or cash payment of the prize is excluded. The prize is non-transferable.

4. Prize settlement

4.1 The winner(s) will be notified via Instagram direct message by WAY OF WATER or the respective competition partner. Regarding the prize, each participant notified in this way is obligated to inform the organizer within 7 business days of sending the notification whether they accept the prize. If the organizer does not receive a corresponding notification within this period, the opportunity to accept the prize will expire, and the organizer reserves the right to select an alternative participant and notify them accordingly.

4.2 Should the participant's contact details be incorrect (e.g., email address), the organizer is not obligated to determine the correct contact details. Any disadvantages resulting from providing incorrect contact details (e.g., incorrect email address) will be borne by the participant.

5. Data protection

All participants' Instagram names will be recorded and stored solely for the purpose of determining the winner. All personal data will be deleted no later than 30 days after the end of the competition; however, comments on Instagram will remain and remain publicly visible. Participants have statutory rights to information, changes, and revocation. Participants may revoke their declared consent to the use of personal data at any time. The revocation must be sent in writing to the WAY OF WATER address provided in the imprint. Upon revocation of consent, the participant's collected and stored personal data will be deleted immediately. Participation in the competition will then no longer be possible.

6. Early termination of the competition

The organizer reserves the right to change, cancel, or terminate the competition without prior notice due to unforeseen circumstances. This applies in particular if software and/or hardware errors occur and/or other technical and/or legal reasons affect or make the regular and proper conduct of the competition impossible.

6. Miscellaneous Legal recourse is excluded. German law applies exclusively. Should any of these provisions be or become invalid, the validity of the remaining terms of use shall remain unaffected. WAY OF WATER may amend these terms of use at any time without separate notification.
